(“Gulf”, “we”, “us” or “our”) Global Privacy Notice applies to (i) the visitors or users of our Website, located at www.usa.gulfoilltd.com, the Gulf Oil International Extranet and any other website which Gulf chooses to link to this Notice at Collection (together, our “Websites”); and (ii) others who engage in business with Gulf, who are residents of Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia.

In addition, in the preceding 12 months, to comply with our legal obligations or for our business or commercial purposes, we may have disclosed all of the categories of Personal Data identified above, to the following categories of third parties: (i) judicial courts, regulators, or other government agents purporting to have jurisdiction over the group or opposing counsel and parties to litigation; (ii) any relevant third party acquirer(s), in the event that we have sold or transferred all or any relevant portion of our business or assets; and (iii) other third parties as may have otherwise been permitted by law.

We do not sell your Personal Data for monetary consideration or as that term is traditionally defined. However, we do engage in certain activities related to marketing, advertising and data analytics that could be a “sale” of Personal Data or engaging in “targeted advertising” under the applicable state privacy laws. We engage in such activities in order to provide you with certain communications and marketing about our products and services. Retention of Personal Data

We will only retain the categories of Personal Data described above for as long as is needed to fulfil the purposes for which it was collected. For example, we may require it for our business purposes, to perform our contractual obligations, or where law or regulation obliges us to do so. We will generally retain your Personal Data throughout the lifecycle of your relationship with us. Some Personal Data will be retained after your relationship with us ends.  We expect to delete your Personal Data (at the latest) once there is no longer any local, state, federal, and other legal requirement or legitimate business purpose for retaining your Personal Information.

We will provide you your Personal Data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit your Personal Data to another controller.
  3. Right to Delete:  You may have the right to request that we delete the Personal Data we have collected about you, subject to certain legal exceptions.
  4. Right to Correct:  You may have the right to request that we correct any inaccurate Personal Data we have collected about you.
  5. Rights to Opt-Out of Targeted Advertising, Sale of Personal Data and/or Profiling:  You may have the right to opt-out of our processing of your Personal Data for the purposes of (i) targeted advertising, (ii) the sale of Personal Data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.  Please note we do not process Personal Data for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects and therefore this opt-out right does not apply.
  6. Right to Appeal:  You may have the right to appeal any of our responses with respect to your Personal Data privacy rights requests. You may do so by submitting to using the “Contact Us” section on our Website.
  7. Right to No Discrimination:  You will not receive any discriminatory treatment by us for the exercise of your privacy rights as outlined in this State Privacy Notice.

Verifying Your Request: Only you, or a person that you authorize to act on your behalf, may make a request related to your Personal Data. In the case of an access and/or deletion request, it must be verifiable before we can fulfill such request. Verifying your request will require you to provide sufficient information for us to reasonably verify that you are the person about whom we collected Personal Data or a person authorized to act on your behalf. We will only use the Personal Data you have provided in a verifiable request in order to verify your request. We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority. 

Opt-Out of Sale and Targeted Advertising

You have the right to opt-out of certain advertising and marketing activities including online tracking that could be considered a sale or processing of your Personal Data for targeted advertising. You can exercise your right to opt-out of the sale or processing of your Personal Data for targeted advertising by clicking the “Your Privacy Choices” link on the footer of our Websites, or through an opt-out preference signal, such as a “Global Privacy Control”. If you choose to exercise this right through an opt-out preference signal and we detect such a signal, it will be honored. If you submit a request to opt-out, including through an opt-out preference signal, after you have agreed to our sale or processing of Personal Data for targeted advertising, we will opt you out of any further sale or processing of Personal Data for targeted advertising.
